Obama Signs Extended Tax Credit into Law

Expected to contribute approximately $22 billion to the economy, Congress overwhelmingly passed a bipartisan measure this week extending the $8,000 home buyer tax credit to April 30, 2010.

The legislation, which is part of a larger bill that also extends unemployment benefits, was signed into law by President Obama today.

More people are now eligible to take advantage of the law, which includes a $6,500 tax credit for buyers who are current home owners and have lived in their home for five of the past eight years.

Income limits for eligible home buyers were also expanded to $125,000 for single buyers and $225,000 for couples, up from $75,000 for individuals and $150,000 for couples. Qualifying home prices are capped at $800,000.

NAR’s Government Affairs Division has compiled facts on the changes made to the current tax credit. NAR members sent more than 500,000 letters to leaders in Congress and made nearly 13,000 telephone calls to Senate offices last weekend to encourage support. So far this year, REALTORS® have spent nearly $14 million lobbying Congress, according to federal campaign finance records compiled by the Center for Responsive Politics.

Sen. Johnny Isakson, a Georgia Republican and a former member of NAR, was key in extending the credit, as well as pushing it through initially. Other prominent boosters include the National Association of Homebuilders and the Mortgage Bankers Association.

FAQ: Appraisal

Q.  Should I get an Appraisal for a property if I am paying cash for the purchase?

A.  Of course!  Please do not neglect to do this very important process of purchase transaction.

When a mortgage is being obtained for a purchase of a property, the lending institution will hire their own appraiser at your expense to evaluate fair market value of the property and this will be a required process of a loan.  However, if you are paying cash, and since there will be no one requiring for you to get an appraisal, you can easily overlook this very important step. 

NC Real Estate Offer to Purchase Agreement has a section where a cash purchase buyer can indicate and make it a part of the contract that the property’s value appraised has to come back at least the selling price.  I have seen more than a few cases of where the buyers are paying cash for their purchase and have paid more than a possible appraisal value of the home.  Of course, anything that has a price will have the value of such price if and as long as someone is willing to pay that price regardless of objective and professional evaluation of a market value.  However, if your intention is to pay a fair price, objectively calculated based on hard data, do recommendation of a reputable appraiser and get it appraised!

Ok, people…  Its closing in, the deadline for you to be eligible as a 1st time home buyer to cash in $8,000 Tax Credit!  You mush close, or have a settlement on a property before the 30th of November.  This means, if you have been looking to buy a house, you will need to be in contract like NOW…  (ok, no pressure, just emphasizing)  It is smart to count about 4-6wks for a lender to get your loan ready after a contract gets both parties signatures.

Mortgage Scams

The government is cracking down on mortgage modification scams, alleging that preying on desperate borrowers caught up in the housing crisis amounts to criminal action.

As we’ve (costco mag) reported on www.fightback.com, mortgage modification services are almost always scams, and real help is available, at low or no cost, from government-approved housing counselors.

The Federal Trade Commission cites these typical signs of mortgage modification rip-off:  promises to stop foreclosure or modify a loan; guarantees that your home will be saved; claims of a “97 percent success rate”; misleading business names that sound like they’re government sponsored.  The worst scammers can actually force borrowers out of their homes by persuading them to sign over the title or grant power of attorney.

The FBI is currently investigation thousands of mortgage fraud cases, which have increased 400 percent in the last five years.  Homeowners looking for help can locate free housing counselors by calling toll free 1-888-995-hope(4673).
