Mortgage Scams

The government is cracking down on mortgage modification scams, alleging that preying on desperate borrowers caught up in the housing crisis amounts to criminal action.

As we’ve (costco mag) reported on www.fightback.com, mortgage modification services are almost always scams, and real help is available, at low or no cost, from government-approved housing counselors.

The Federal Trade Commission cites these typical signs of mortgage modification rip-off:  promises to stop foreclosure or modify a loan; guarantees that your home will be saved; claims of a “97 percent success rate”; misleading business names that sound like they’re government sponsored.  The worst scammers can actually force borrowers out of their homes by persuading them to sign over the title or grant power of attorney.

The FBI is currently investigation thousands of mortgage fraud cases, which have increased 400 percent in the last five years.  Homeowners looking for help can locate free housing counselors by calling toll free 1-888-995-hope(4673). 

$8,000 Tax Credit – Use as Downpay??

Well, I have just been informed that this tax credit being used as a downpayment is not the case in the State of North Carolina.  The information I’ve heard is that only 10 states are allowing this fund to be used as a downpayment.  What is weird is that there are so many conflicting information about this and no one has a definitive answer.  I will try researching this further and will post again of my findings.  Please visit back to check on it!

  • That the first time home buyer credit of $8,000 for 2009 is an increase from $7,500 for 2008 buyers?
  • That you don’t have to pay this $8,000 back while $7,500 for 2008 is required to be paid back over the period of 15 years? This $7,500 was more like an interest-free loan and this paying back over 15 years starts from an individual’s 2010 tax return.
  • That this credit only applies to a principal residence or owner-occupied housing?
  • That a person can be considered a first-time buyer if he/she has not had any ownership interest in a home in the three years previous to the day of the 2009 purchase?
  • That a minimum purchase amount for $8,000 credit is $80,000 purchase price? If the house costs less than $80,000, the credit will be 10% of the cost. Thus, if an individual purchased a home for $75,000, the credit would be $7,500.

Tax Credit ($8,000) Can Be Used on Downpayment/Closing Costs

FHA-approved lenders received the go-ahead to develop bridge-loan products that enable first time home buyers to use the benefits of the federal tax credit upfront, according to eagerly awaited guidance from the U.S. Department of Housing and Urban Development on so-called home buyer tax credit loans that was released 5/29/2009.

  • Average wage has increased 14% since 2003
  • Average sales price has increased 28% since 2003
  • 96% of Wake County, Raleigh/Cary market sales within the past 13 months were non-foreclosure
  • Jan-Feb prices increased 3.8% in the Pacific Census Division
