Summer is finally here!  I hope you are all enjoying the beautiful sunshine, yummy watermelon and corn on the cob, and fireworks!  Here is June’s real estate market summary for Tooele and Salt Lake counties.  I apologize for them being out later than usual, but I just got back from Girl’s Camp and a family reunion which kept me hoppin all of last week, so now I am playing catch up.  Here is the report:

April was a busy month in the real estate market, especially with people scrambling to get a home under contract before the home buyer tax credit expiration date that fell on April 30, 2010. We have seen a large increase in the number of homes sold, but also a continued decline in the sales prices. Here are the numbers for you!

December 2009 Tooele and Salt Lake County Market Summaries

The past year the market has been edging downward, but we are beginning to see some promising statistics for Tooele and Salt Lake Counties.  Typically the State of Utah lags behind what the national housing market does, and Tooele County lags behind what Salt Lake County does.  As we have been hearing positive reports coming from across the country, I am very optimistic for this year!  We are beginning to see signs of life returning to our markets!  This is great for sellers, but not as good for buyers.  Here is the information from last month’s real estate transactions:

Transfer Fees on Properties in Tooele, Utah

A new and alarming trend has reached Tooele County.  Transfer fees, which can be recorded on a property, have arrived.  Transfer fees are fees that are found on the title of a piece of property that require the selling party to pay a certain percentage of the purchase price to a third party, often a developer, upon sale of the property.  For instance, let’s say that a buyer bought a 1 acre parcel of land for $100,000.  They then built a house, landscaped the property, and made other improvements.  The homeowner then decides to sell the property.  They find a buyer and sell the property for $400,000.  On title it is found that a 1% transfer fee was recorded by the developer for 99 years.   At closing $4,000 will be taken from the sellers proceeds and paid to the developer due to the 1% transfer fee.  This scenario will occur every time the property is sold.

I see many problems with this.  A couple of those are reduced proceeds to the homeowner when they sell and fewer people who will be able to purchase properties that have a transfer fee. 

The homeowner is the person who has spent the time and money to make improvements to their own property.  Why should a 3rd party benefit from their efforts?  Developers may argue that it was their time and money invested that made it possible for the homeowner to build in the development.  Developers should charge enough for their land that they make up the costs they incurred during development.  They should not seek to make additional money later based on the improvements made at someone else’ expense.

There has been talk among title insurance companies that they will not insure properties that have these fees on their title.  If a buyer cannot secure title insurance, they may not be able to secure a loan to purchase the property as lenders require a title insurance policy be issued to protect their interests.  This would limit the number of potential buyers who could purchase a property to cash buyers.  There are not many people who can pay cash!

There is talk at the State level of passing laws that will ban this practice in Utah.  I hope the legislator see the wisdom in this and pass laws to protect property owners during their next session.  Until then, make sure you use a knowledgeable Realtor to help guide you through any real estate transaction so that any pitfalls may be avoided!

Property Tax Appeal Deadline in Tooele, UT

I just wanted to send a reminder out to everyone about the property tax appeal deadline that has been set in Tooele County, Utah.  Tooele County has requested that appeals be received by August 31, 2009.  No appeals will be accepted after September 15, 2009, at 6:00 p.m. 

This is a very important date for many of you who found that your property values had skyrocketed when the county assessor’s office reappraised many areas of the county this year.   I don’t agree with how they went about reassessing value without, it seems, doing any real work.  It appears that they just picked an area and looked at some listings and then set the price.  Appraisals are based on SOLD data NOT LISTING data, so the new appraisals have been very high and very inaccurate. 

To appeal your tax assessment if you feel your property value has been overstated, you can visit the Tooele County web site for instructions and the form.  Tax Appeal Form  One of the items that can be used as evidence to prove the value of your home is a set of at least 3 comparable properties that sold in the tax year.   If you need assistance obtaining information on 3 properties that sold in 2008, please contact me and I will help you.

Also, as property values have continued to decrease slightly in 2009, it may be worth it to appeal again next year to get the value where it should be.   I don’t think anyone minds paying their fair share of taxes based on a fair market value, but the assessments that I have seen are certainly not based on fair market value.
